Kevin Mark Lynch, 43, will spend two years of active jail time for possession of child pornography. Lynch was sentenced, Tuesday, in Bedford County Circuit Court.
Last month he pleaded guilty to 15 counts of possession of child pornography. He received a 10-year sentence, with eight years suspended.
Lynch had worked professionally, counseling long-term substance abusers and Defense Attorney John Bradley presented character witnesses, one of whom testified to how Lynch’s work helped her turn her life around.
“At some point did it get to you?” Bradley asked Lynch, concerning his work.
    “Yeah,” Lynch replied.
Lynch said that he had been doing this work for 20 years.
“As time went on, I started having very vivid nightmares,” he said.
Lynch also testified that he started finding items on his computer, including child porn. He said that he had been undergoing therapy for two years and said that he does not remember downloading the child porn.
The sentencing guidelines called for a sentence of between 7-and-a-half years and 16 years in prison. Bradley called this excessive and asked Judge James Updike to take into account the good Lynch had done and the number of people he helped as a counselor.
Judge Updike expressed his concern that possession of child pornography encourages its production and that seriously injures children. Updike said that he felt that significant punishment must be imposed but that the guidelines are too severe in Lynch’s case.
The sentence Judge Updike handed down will put Lynch behind bars for two years. He will also have to register as a sex offender and is barred from having a computer with access to the Internet outside of work. He is also barred from having unsupervised contact with a minor.
“Mr. Lynch, it is my hope that you serve your time, put this behind you, and do better in the future,” Judge Updike said to Lynch.
